PROCEDURE FOR ISSUANCE OF PERMITS FOR FLIGHTS OF CIVIL AIRCRAFT IN THE BORDER AREAThis aeronautical information circular presents updated procedure for issuance of permits for flights of civil aircraft in the border area of the Republic of Lithuania, approved by of the Commander of the Lithuanian Armed Forces Order No. V-512 of 28 April 2020.THE DESCRIPTION OF THE PROCEDURE FOR ISSUANCE OF PERMITS FOR FLIGHTS OF CIVIL AIRCRAFT IN THE BORDER AREA OF THE REPUBLIC OF LITHUANIA CHAPTER I GENERAL PROVISIONS1. The Description of the Procedure for Issuance of Permits for Flights of Civil Aircraft in the Border Area of the Republic of Lithuania (hereinafter referred to as the Description of the Procedure) establishes the conditions and procedure for issuance of permits for flights of civil aircraft in the border area of the Republic of Lithuania.2. The concepts used in the description are understood as explained under the Law on Aviation of the Republic of Lithuania (hereinafter referred to as the Law on Aviation) and the Law on the Protection of Objects of Importance to Ensuring National Security of the Republic of Lithuania.3. This Description of Procedure shall not be applied to international flights, when the state border of the Republic of Lithuania with the countries that are not member states of Schengen Area (having resumed the internal border control – to all international flights), and to flights of the aircraft which belong to the state.4. This Description of Procedure shall not be applied to flights of unmanned aerial vehicles performed in the traffic zones of the aerodromes which are in the border area and to flights of unmanned aerial vehicles, which belong to the state.CHAPTER II THE CONDITIONS AND PROCEDURES FOR ISSUANCE OF PERMITS 5. A permit for civil aircraft flight in the border area of the Republic of Lithuania (hereinafter referred to as permit) may be obtained upon submitting a filled application (hereinafter referred to as application) by the aircraft pilot (Annex). The application shall be submitted to the Lithuanian Air Force of the Lithuanian Armed Forces by fax +370 37 39 9027 or by e-mail paraiskos.kop@mil.lt, not later than within 3 (three) working days before the intended take-off time.6. One application shall be submitted for not more than one aircraft.7. Permit may be issued in exceptional cases only, i.e. when it is necessary to:7.1 perform, monitor or control the activities of the objects of strategic importance to national security in the border area of the Republic of Lithuania, included into the List of Enterprises and Equipment of Strategic Importance to National Security and other Enterprises of Importance for Ensuring National Security of the Republic of Lithuania;7.2 perform the activity of state and municipality institutions;7.3 perform agricultural activities;7.4 perform vaccination actions;7.5 carry out aerial photography, when performing cartography/demarcation actions;7.6 perform calibration flights (flight inspections).8. A permit shall not be issued:8.1 if the submitted application is filled incorrectly;8.2 if the application is submitted failing to comply with the term, established under Item 5 of the Description of the Procedure;8.3 to flights of group, sport, recreational, entertainment and similar nature;8.4 if in the certain area of airspace and on time specified in the application the flights of state aircraft of Lithuania and NATO/EU member states are being conducted or planned to be conducted;8.5 if in the certain area of airspace and on time specified in the application search and rescue operations are being conducted or planned to be conducted;8.6 if a civil aircraft is not equipped with facilities, specified under Items 2 and 3 of Paragraph 3 of Article 35 of the Law on Aviation;8.7 in other cases, not covered by Items 8.1–8.6 of the Description of the Procedure, taking into consideration the situation in the border area of the Republic of Lithuania, and in the absence of cases specified under Paragraph 7. In this case it is not obligatory for the person making the decision on non-issuance of the permit to provide arguments for the decision made to the person (pilot) submitting the application.9. The decision on issuance or non-issuance of a permit shall be made by the Commander of the Lithuanian Air Force (hereinafter referred to as KOP) of the Lithuanian Armed Forces or an officer authorised by him. An appeal against a decision on non-issuance of a permit may be submitted to the Commander of the Lithuanian Armed Forces. The appeal on non-issuance of a permit is submitted and analysed following the procedure established under the Rules on Analysing Applications and Appeals also Providing Services to Persons at Public Administration Subjects, ratified by the Order no. 875 of 22 August 2007 of the Government of the Republic of Lithuania “On Ratification of the Rules on Analysing Applications and Appeals also Providing Services to Persons at Public Administration Subjects” and administrative service “Analysing the Appeals and Statements of Persons at the Lithuanian Armed Forces”, ratified by the Order no. VL-47 of 10 September 2013 of the Commander of the Lithuanian Armed Forces.10. Upon making a decision to issue a permit, the issuance of a permit shall be noted in the application, the permit number shall be filled and it shall be signed by the Commander of the Lithuanian Air Force (KOP) or an officer authorised by him. The Operational Duty Officer of the Air Force (KOP OB) shall notify Air Traffic Flow Planning and Data Processing Division of state enterprise Oro Navigacija (by e-mail fmp@ans.lt) and the Duty Officer(s) of the border district(s) of the State Border Guard Service, which is responsible for the area in which the flight(s) is executed about the issued permit. Upon deciding not to issue a permit, refusal to issue shall be noted in the application, providing the reasons due to which the permit shall not be issued, and it shall be signed by the Commander of Lithuanian Air Force (KOP) or an officer authorised by him. The applicant shall be notified about the decision made on (non)issuance of the permit not later than within 2 (two) working days after the reception of the application using the contact information indicated in the application.CHAPTER III FINAL PROVISIONS11. A permit shall be valid for one aircraft only and for the flight route indicated in the application only for the specified time. 12. The permit number rendered for the flight must be filled into box no. 18 of the flight plan (other information), while the flight route must be filled into box no. 15 of the flight plan. In case the flight plan is not submitted, the issued permit shall be considered invalid.13. The pilot shall be liable to:13.1 ensure that in the course of the flight the flight conditions established under the Law on Aviation and other documents regulating the aviation activity also indicated in the issued permit are followed;13.2 notify the Operational Duty Officer of the Air Force (KOP OB) by telephone +370 37 30 7504, telephone +370 800 01 236 or e-mail paraiskos.kop@mil.lt, in case the flight shall not be executed due to any reasons. 14. In case a flight shall not be executed due to any reasons , the Operational Duty Officer of the Lithuanian Air Force (KOP OB) shall notify Air Traffic Flow Planning and Data Processing Division of state enterprise Oro Navigacija about the cancellation/revocation of the permit by e-mail fmp@ans.lt.15. The Commander of the Lithuanian Airforce or an officer authorised by him may cancel a permit to fly in the border area of the Republic of Lithuania at any time (even when significant circumstances occur in the course of the flight or due to the safety of the flight). All possible measure may be deployed for cancellation of the permit, in order to ensure the fastest termination of the flight. 16.
