﻿<?xml version="1.0" encoding="utf-8"?><e:ENR-1.13 Number="ENR 1.13" IsChapter="true" id="i14599" xmlns:e="http://www.eurocontrol.int/xmlns/AIM/eAIP"><e:Title id="i14603" Updated="No" LastDataDrivenCheck="638877517428606423" LastDataDrivenUpdate="638384810294780671" xml:space="preserve">UNLAWFUL INTERFERENCE</e:Title><e:Sub-section Number="1" id="i79987" Updated="No" class="Body"><e:Title id="i79988" Updated="No" class="Title1" xml:space="preserve">GENERAL</e:Title><x:p xml:space="preserve" id="i79991" Updated="No" class="Paragraph" xmlns:x="http://www.w3.org/1999/xhtml">The following procedures are intended for use by aircraft when unlawful interference occurs and the aircraft is unable to notify an <e:Abbreviation Ref="i16688" Ident="ATS" Value="ATS" id="i197651" Updated="No" /> unit of this fact.</x:p></e:Sub-section><e:Sub-section Number="2" id="i79995" Updated="No" class="Body"><e:Title id="i79996" Updated="No" class="Title1" xml:space="preserve">PROCEDURES</e:Title><x:div xml:space="preserve" id="i79999" Updated="No" class="Paragraph11" Number="2.1" xmlns:x="http://www.w3.org/1999/xhtml">The aircraft that became the object of unlawful inference shall try to report the event to a corresponding <e:Abbreviation Ref="i16639" Ident="ATC" Value="ATC" id="i197653" Updated="No" />, informing it about all important circumstances and all deviations from the flight plan that are connected with the event. It shall be done to enable the ATC to guarantee consecutive actions as far as the operations intended to help the endangered aircraft are concerned and to lessen the conflicting situation between this and the rest of aircraft.</x:div><x:div xml:space="preserve" id="i80002" Updated="No" class="Paragraph11" Number="2.2" xmlns:x="http://www.w3.org/1999/xhtml">Aircraft which are equipped with transponder shall set, whenever it is possible, the A mode 7500 code.</x:div><x:div xml:space="preserve" id="i80005" Updated="No" class="Paragraph11" Number="2.3" xmlns:x="http://www.w3.org/1999/xhtml">If the aircraft commander cannot report the events to a corresponding air traffic control unit and there are no additional circumstances he should try to continue the flight along the flight planned route at the designated cruising level at least till the moment he will be able to report to a corresponding ATC or will enter the area under radar control.</x:div><x:div xml:space="preserve" id="i80008" Updated="No" class="Paragraph11" Number="2.4" xmlns:x="http://www.w3.org/1999/xhtml">When an aircraft is forced to deviate from its established way or the established cruising level and being unable to establish radiotelephony communication with the ATC and if it is possible the aircraft commander should:</x:div><x:ol xml:space="preserve" id="i80016" Updated="No" class="lia" xmlns:x="http://www.w3.org/1999/xhtml"><x:li xml:space="preserve" id="i80017" Updated="No" class="lia">try to pass the warning on the emergency <e:Abbreviation Ref="i22390" Ident="VHF" Value="VHF" id="i197655" Updated="No" /> frequency or any other corresponding frequencies, except the cases when it is impossible to do it. When it is necessary and there are favourable circumstances, it is recommendable to use any other equipment (the transponder, a data transfer line and other), and</x:li><x:li xml:space="preserve" id="i80018" Updated="No" class="lia">to continue the flight using the corresponding special operational procedure when flying under specific circumstances in the case when such procedures are approved and published in the <e:Abbreviation Ref="i18731" Ident="ICAO" Value="ICAO" id="i197657" Updated="No" /> Doc 7030 (Supplementary Regional Procedures); or</x:li><x:li xml:space="preserve" id="i80019" Updated="No" class="lia">if there are no corresponding regional rules, to continue the flight at such level, which would differ from the cruising levels ordinary used for <e:Abbreviation Ref="i18782" Ident="IFR" Value="IFR" id="i197659" Updated="No" /> flights in this area by 300 M (1 000 FT), if the flight is above FL290 or by 150 M (500 FT) if the flight is below FL290.</x:li></x:ol><x:div xml:space="preserve" id="i80022" Updated="No" class="Paragraph11" Number="2.5" xmlns:x="http://www.w3.org/1999/xhtml">The interception of aircraft is carried out following the procedure established by Commission Implementing Regulation (EU) No 923/2012.</x:div></e:Sub-section></e:ENR-1.13>
