﻿<?xml version="1.0" encoding="utf-8"?><e:GEN-1.4 Number="GEN 1.4" IsChapter="true" id="i14401" xmlns:e="http://www.eurocontrol.int/xmlns/AIM/eAIP"><e:Title id="i14405" Updated="No" LastDataDrivenCheck="639011238304806469" xml:space="preserve">ENTRY, TRANSIT AND DEPARTURE OF CARGO</e:Title><e:Sub-section Number="1" id="i15959" Updated="No" class="Body"><e:Title id="i15960" Updated="No" class="Title1" xml:space="preserve">GENERAL </e:Title><x:div xml:space="preserve" id="i15961" Updated="No" class="Paragraph11" Number="1.1" xmlns:x="http://www.w3.org/1999/xhtml">Arriving or departing aircraft, their crews, passengers and their luggage, aircraft provision, cargo and mail to the Republic of Lithuania can get into the customs territory or get out of it only after they are checked by the officials of the airport security service, State border guard service (hereinafter SBGS), customs house, public health care service, veterinary and plant quarantine service. The aviation security check of the arriving aircraft, their crew, passengers and their luggage, aircraft provision, cargo and mail is carried at random.</x:div><x:div xml:space="preserve" id="i15962" Updated="No" class="Paragraph11" Number="1.2" xmlns:x="http://www.w3.org/1999/xhtml">If during an international flight to or from an international airport of the Republic of Lithuania the aircraft lands at some other transit airport of the Republic of Lithuania, the passengers who get off or board the aircraft, their luggage, cargo that are loaded or unloaded to the aircraft and mail must undergo SBGS, customs or any other obligatory check at this transit airport. SBGS, customs and other obligatory check of the aircraft, crew members and the rest of the passengers, their luggage, cargo and mail is carried at the final (or initial) international airport of the Republic of Lithuania.</x:div><x:div xml:space="preserve" id="i15963" Updated="No" class="Paragraph11" Number="1.3" xmlns:x="http://www.w3.org/1999/xhtml">Imported or transit cargo that was delivered by aircraft, except that part which is prohibited or limited by law and other judicial acts of the Republic of Lithuania, and passenger personal articles, aircraft provision, mail can be temporary stored only at the established temporary cargo storage warehouses and exposed to the customs check, the temporary storage documents of this cargo being drawn up according to the order established by the Customs Department, or after SBGS, customs and all other necessary check has been carried out the cargo can be loaded directly onto the transportation means on the customs officer’s permission in the cases when a person at whose disposal the cargo is or who has a right to transport them, or a person authorised by him does not wish to store the cargo and declares the cargo immediately for the selected customs procedure.</x:div></e:Sub-section><e:Sub-section Number="2" id="i15967" Updated="No" class="Body"><e:Title id="i15972" Updated="No" class="Title1" xml:space="preserve">CUSTOMS REQUIREMENTS CONCERNING CARGO AND OTHER ARTICLES</e:Title><x:div xml:space="preserve" id="i15969" Updated="No" class="Paragraph11" Number="2.1" xmlns:x="http://www.w3.org/1999/xhtml">Before unloading cargo from the aircraft the customs official is presented with a copy of the cargo list and for the mail - a copy of the airmail transfer list. After SBGS check a customs official permits to unload the cargo in oral or in written form or by means of communication following standard work procedure. Customs-supervised goods are declared for temporary storage or for a selected customs procedure through the smart customs declaration processing system. Documents (shipping invoices, invoices and invoice pro formas) are provided by means of the system upon request by customs.</x:div><x:div xml:space="preserve" id="i16003" Updated="No" class="Paragraph11" Number="2.2" xmlns:x="http://www.w3.org/1999/xhtml">The customs check of imported and transit cargo and mail is carried out at the territory of the international airport border control check–point or at the cargo storing points under the supervision of the customs house. The procedure is arranged following the order established by the Customs Department.</x:div><x:div xml:space="preserve" id="i62552" Updated="No" class="Paragraph11" Number="2.3" xmlns:x="http://www.w3.org/1999/xhtml">If the weight and quantity of the transported cargo is evidently different from the transportation documents or if the packages of the cargo are destroyed, the representative of the airline or the company, executing the aircraft ground handling or the owner of the cargo or his authorised representative fill a cargo check act in a free form in the presence of a customs representative and a representative of the cargo storage cared of by the customs. Cargo is registered and declared by the owner (operator) of the warehouse cared of by the customs, taking into account the data of the cargo check act.</x:div><x:div xml:space="preserve" id="i62555" Updated="No" class="Paragraph11" Number="2.4" xmlns:x="http://www.w3.org/1999/xhtml">A person at whose disposal the cargo is and an authorised representative after the application has been submitted through the Customs Authorisations Portal and upon receiving the permit have a right to examine the cargo, to take their samples under the supervision of a customs official. If the cargo was transported in sealed packages, the cargo can be examined or the samples taken only after the customs official has removed the seals.</x:div><x:div xml:space="preserve" id="i62560" Updated="No" class="Paragraph11" Number="2.5" xmlns:x="http://www.w3.org/1999/xhtml">Export or transit cargo, which has undergone the necessary transit formalities at the customs house can be loaded on board the aircraft straight from the ground transportation vehicles after the aviation security and all other obligatory check has been finished, all the transit formalities being finished at the destination customs office following the procedure established by the Customs Department.</x:div><x:div xml:space="preserve" id="i62561" Updated="No" class="Paragraph11" Number="2.6" xmlns:x="http://www.w3.org/1999/xhtml">If the aircraft was forced to land or if it crosses the Republic of Lithuania in transit, the cargo can be taken for a temporary storage to the cargo temporary storage place cared of by the customs house.</x:div><x:div xml:space="preserve" id="i62564" Updated="No" class="Paragraph11" Number="2.7" xmlns:x="http://www.w3.org/1999/xhtml">If the aircraft does not take-off from the runway, all the cargo on board the aircraft can be taken for a temporary storage to a temporary storage place cared of by the customs house. </x:div><x:div xml:space="preserve" id="i62569" Updated="No" class="Paragraph11" Number="2.8" xmlns:x="http://www.w3.org/1999/xhtml">Cargo unlawfully brought into the territory of the customs of the Republic of Lithuania, hidden or backing the owner, transported here without transportation documents or with dubious information in them (when there are unauthorised corrections) are detained following the laws of the Republic of Lithuania and the procedure established by other legal documents. After having formed the detention protocol, cargo is taken for storage to the detained cargo storage place. The owner (operator) of the temporary storage place cared of by the customs must establish a detained cargo storage place. The customs house has a right to keep such cargo at the detained cargo storage place as long as the situation related to the detained goods is resolved - they are handed over to the owner of the goods or his authorized person, or the cargo is confiscated. The detained cargo is stored, sold or destroyed according to the procedure prescribed by the laws and other legal documents of the Republic of Lithuania.</x:div></e:Sub-section><e:Sub-section Number="3" id="i62604" Updated="No" class="Body"><e:Title id="i62605" Updated="No" class="Title1" xml:space="preserve">AGRICULTURAL QUARANTINE REQUIREMENTS</e:Title><x:div xml:space="preserve" id="i62607" Updated="No" class="Paragraph11" Number="3.1" xmlns:x="http://www.w3.org/1999/xhtml">Plants, plant products and other objects may be imported only through those border-crossing points of the Republic of Lithuania which have posts of phytosanitary control, or other entry points, where the phytosanitary condition of plants, plant products and other objects is inspected by the State Plant Service.</x:div><x:div xml:space="preserve" id="i62608" Updated="No" class="Paragraph11" Number="3.2" xmlns:x="http://www.w3.org/1999/xhtml">All natural and legal persons as well as enterprises without the status of a legal person importing plants, plant products and other objects must follow the provisions laid down in the legal acts regulating imports of plants, plant products and other objects, declare the imported consignment, produce the documents of the consignment, and must not interfere with the controls which are carried out by the officers of the State Plant Service.</x:div><x:div xml:space="preserve" id="i62609" Updated="No" class="Paragraph11" Number="3.3" xmlns:x="http://www.w3.org/1999/xhtml">The control of the phytosanitary condition of plants, plant products and other objects during their importation and transit shall be carried out by the officers of State Plant Service. Phytosanitary control which shall consist of checking of the consignment documents, visual inspection of the consignment and trials of samples, must be carried out before the customs clearance.</x:div><x:div xml:space="preserve" id="i62610" Updated="No" class="Paragraph11" Number="3.4" xmlns:x="http://www.w3.org/1999/xhtml">Plants, plant products and other objects must meet phytosanitary requirements at the stage of their growing, production, storage, marketing and transportation.</x:div><x:div xml:space="preserve" id="i62611" Updated="No" class="Paragraph11" Number="3.5" xmlns:x="http://www.w3.org/1999/xhtml">It shall be prohibited to import, store, transport and propagate harmful organisms at any stage of their development</x:div><x:div xml:space="preserve" id="i62612" Updated="No" class="Paragraph11" Number="3.6" xmlns:x="http://www.w3.org/1999/xhtml">Plants, plant products and other objects imported or in transit shall be free from contamination with harmful organisms, at any stage of their development, which are specified in the lists approved by the Minister of Agriculture.</x:div><x:div xml:space="preserve" id="i62613" Updated="No" class="Paragraph11" Number="3.7" xmlns:x="http://www.w3.org/1999/xhtml">Provisions of paragraph <x:a id="i352748" Updated="No" LastDataDrivenCheck="639011238305138782" href="#i62612">3.6</x:a> of this section may not apply to plants, plant products and other objects which are in transit in tightly closed and sealed reservoirs without reloading them in the territory of the Republic of Lithuania on condition that there is no risk of spread of harmful organisms.</x:div><x:div xml:space="preserve" id="i62614" Updated="No" class="Paragraph11" Number="3.8" xmlns:x="http://www.w3.org/1999/xhtml">Plants, plant products and other objects imported into the Republic of Lithuania and intended for personal consumption must conform to the prescribed phytosanitary requirements.</x:div><x:div xml:space="preserve" id="i62615" Updated="No" class="Paragraph11" Number="3.9" xmlns:x="http://www.w3.org/1999/xhtml">The State Plant Service, in accordance with the established procedure, may allow imports of harmful organisms, plants, plant products or other objects the importation of which is forbidden, where these will be exclusively used in scientific investigation purposes or for work on varietal selection.</x:div><x:div xml:space="preserve" id="i62616" Updated="No" class="Paragraph11" Number="3.10" xmlns:x="http://www.w3.org/1999/xhtml">The exporter of every consignment of plants, plant products or other objects intended for export must have its phytosanitary certificate which is granted subject to the compliance with the requirements of the country of destination.</x:div><x:div xml:space="preserve" id="i62617" Updated="No" class="Paragraph11" Number="3.11" xmlns:x="http://www.w3.org/1999/xhtml">Phytosanitary certificates for export of plants, plant products and other objects shall be issued by the State Plant Service in accordance with the established procedure.</x:div><x:div xml:space="preserve" id="i62618" Updated="No" class="Paragraph11" Number="3.12" xmlns:x="http://www.w3.org/1999/xhtml">All additional costs of phytosanitary controls of plants, plant products and other objects subject to import and export, treatment of the consignment or its destruction shall be covered by the importer, exporter, or their authorized representatives.</x:div></e:Sub-section></e:GEN-1.4>
